Binding Individual Arbitration. If a claim is filed in small claims court and subsequently transferred, removed, or appealed to a different court, either party may elect to have the matter proceed in arbitration instead.

Arbitration Costs and Fairness. CashLoansExpress will pay all AAA filing fees, administration fees, and arbitrator fees for claims of $10,000 or less. For claims exceeding $10,000, fees will be allocated according to the AAA Consumer Arbitration Rules. You may choose whether the arbitration will be conducted solely on the basis of documents submitted, through a telephonic or video hearing, or by an in-person hearing in your county of residence. The arbitrator may award any relief that would be available in court, including injunctive or declaratory relief, compensatory damages, and attorneys’ fees and costs where authorized by applicable law. This arbitration provision is intended to be fair to both parties.

Exceptions. Either party may bring a lawsuit in court solely for injunctive relief to stop unauthorized use or abuse of our Services or infringement of intellectual property rights without first engaging in arbitration.

Governing Law. This arbitration provision is governed exclusively by the Federal Arbitration Act, 9 U.S.C. §§ 1 et seq. (the “FAA”), and evidences a transaction involving interstate commerce. The FAA shall govern the interpretation, enforcement, and proceedings pursuant to this arbitration provision, notwithstanding any other choice of law provisions in these Terms or any state law to the contrary.

Jurisdiction and Governing Law. Except as provided in the preceding paragraph regarding the FAA’s exclusive governance of arbitration, this Agreement shall be governed by the laws of the State of Delaware, without regard to conflict of law principles. If for any reason a Dispute proceeds in court rather than arbitration, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Delaware, and waive any objections to such jurisdiction or venue.

Time Limit to Initiate a Dispute. Any claim or cause of action you may have arising out of or related to the Website, Services, or Content must be initiated within one (1) year from the date the claim arose or the date on which you reasonably should have discovered it. Otherwise, such claim is permanently barred.

25. No Class Action

To the fullest extent permitted by law, you and CashLoansExpress agree that any dispute resolution will be conducted solely on an individual basis and not in a class, consolidated, or representative action. You understand and agree that you are waiving your right to participate as a plaintiff or class member in any purported class action, class arbitration, private attorney general action, or other representative proceeding. If this class action waiver is found to be unenforceable as to a particular claim or request for relief, then that claim or request for relief shall be severed, and all remaining claims shall continue to be subject to arbitration on an individual basis.

26. Severability and Entire Agreement

If any provision of this Agreement, including the arbitration clause, is found to be invalid or unenforceable, that provision shall be reformed to the extent necessary to make it enforceable, consistent with the intent of the original provision. Such a finding shall not affect the enforceability of the remaining provisions of this Agreement.
